It is my intent as a participant or player competing and participating in FINS SWIMMING a Maryland corporation (“FINS”) sanctioned activities (including training, practices, meets, lessons, etc.), while participating during activities including any pre-game or post-game activities at FINS that I acknowledge, appreciate, and agree to the following:
I acknowledge that I am aware that there are risks to me of exposure to directly or indirectly arising out of, contributed to, by, or resulting from: An outbreak of any and all communicable disease, including but not limited to, the virus “severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2)”, Middle East Respiratory Syndrome (“MERS”), influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist, and cannot be entirely eliminated; and, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, or others, and assume full responsibility for my participation in the Activities; and, I willingly agree to comply with guidelines adopted by FINS for participation as it pertains to protection against infectious diseases. If, however, I observe any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and, In consideration of having the opportunity to participate as either a team member or competitor at OLD FARM SWIM AND PADDLE TENNIS CLUB or GEORGETOWN PREP SCHOOL, and in acknowledging that I am aware of and willing to assume the risks associated with this activity, I hereby voluntarily agree to waive, hold harmless and indemnify FINS and its trustees, agents, volunteers and employees from any and all claims, demands, damages and causes of action of any nature whatsoever arising out of ordinary negligence which I, my heirs, my assigns or successors may have against them for, on account of, or by reason of my participation in the above activities WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property in connection with the Activities, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
This document does not limit the applicability of any other document to which I am bound waiving or releasing FINS, and/or assuming the risks associated with my participation in the Activities. I, the participant, indicate my agreement to this hold harmless elective by providing my electronic signature. I, as parent/guardian, with legal responsibility for the participant I am enrolling into a FINS sponsored activity or event identified above, have read and explained the provisions in this document to my child/ward, including the risks of presence and participation in the Activities, and his/her personal responsibilities for adhering to guidelines adopted by FINS for protection against communicable diseases, and that such diseases may be contracted even if such guidelines are followed. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do hereby release and agree to indemnify and hold harmless the Releasees, for any and all liabilities or claims incident to my minor child’s/ward’s presence or participation in the Activities as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent provided by law. In addition, on behalf of myself, my spouse and my child/ward, I assume the risk of myself, my spouse, and my child/ward contracting communicable diseases at the Activities, and/or providing transportation to my child/ward.
I HAVE CAREFULLY READ THE ABOVE INFECTIOUS DISEASES WAIVER AND RELEASE AND ASSUMPTIONS OF RISK AGREEMENT AND SIGN IT WITH FULL KNOWLEDGE OF ITS CONTENTS AND SIGNIFICANCE.
